Thesis structure:
introduction, three chapters, conclusions and recommendations, bibliography of 153 titles, 12 annexes, 138 basic text pages, 23 figures, 16 tables and 6 formulas. The results were published in 10 scientific papers, 2 national reports, and 1 guide.
Study field: management of intellectual property.
Aim of the work:
development of theoretical foundations of intellectual property, synthesis of deficiencies of the national system of geographical indications and formulation of methodical and practical recommendations for improving the management of geographical indications system in the Republic of Moldova.
Objectives:
to analyze the economic implications of geographical indications, to systematize the economic, social and environmental functions of geographical indications, to analyze the potential implications of development of the geographical indications system in the Republic of Moldova following the entry into force of the Agreement on the establishment of the Deep and Comprehensive Free Trade Area and the Association Agreement between the Republic of Moldova and the European Union and to develop recommendations for improving the local management of geographical indications system.
Novelty and scientific originality:
the notion of geographical indications system from the economic point of view was defined, the place and role of geographical indications within other objects of intellectual property was established and reasoned, the economic, social and environmental functions of geographical indications where systemized, some tools to assess the economic impact of geographical indications was developped, the gaps of the national system of geographical indications have been synthesized and well-reasoned recommendations aimed at ensuring the efficient management of the geographical indications system in the Republic of Moldova was developped.
Important results for science and practice:
it was reasoned the attribution of geographical indications to the category of intellectual property objects, the notion of geographical indications system from the economic point of view was defined, there were systematized the socioeconomic functions of geographical indications, were identified the weaknesses of the national system of geographical indications and developed a set of tools to overcome them, which caused the solution of a major applicative problem – exploitation of the potential of local products on domestic market and foreign markets outlined in the National Intellectual Property Strategy until 2020 and the Strategy for Agriculture and Rural Environment Development in Moldova 2014 – 2020.
Theoretical importance and applicative value of the research:
on the basis of the analysis of deficiencies of the geographical indications system and of the potential of geographical indications system in the Republic of Moldova, it was reasoned the conceptual approach, proposed the priority directions and mechanisms to improve the management of geographical indications system which creates the basis for building a strong and strengthened geographical indications system.
Implementation of scientific results.
The main results of the thesis were implemented in Law No. 66/2008 on the Protection of Geographical Indications, Appellations of Origin and Traditional Specialties Guaranteed and Government Decision No. 610/2010 approving the Regulations on the Procedure of Filing, Examination and Registration of Geographical Indications, Appellations of Origin and Traditional Specialties Guaranteed. Other results are to be implemented over the coming years by amending the legislative acts in the reference field and by registering new geographical indications following the consultations and guidance given by the author to representatives of private environment. Implementation of the achieved results is confirmed by the obtaining of implementation certificates issued by the State Agency on Intellectual Property, Competitiveness Enhancement and Enterprise Development II Project and Berry Producers Association “Bacifera”.
