The Dissertation thesis work reflects the scientific and practical researches of the author in the field of control over the activity of local and regional councils, mayors, presidents of districts (raions) which exercised by the Government directly or through the authorized governmental bodies.
Taking into the account standards and principles of the European Charter of Local Self-Government in the field of supervision of higher-level authorities over local authorities, the purpose of this research is complex, including comparative study of doctrines and the legislation of the Republic Moldova as well as those of countries concerning a legal phenomenon “the administrative supervision of the central government over local authorities” in conditions of decentralization and local autonomy.
The research covers such important aspects as the concept and terms of local public administration and administrative supervision, agents of the administrative supervision, power of the administrative supervision bodies, forms of administrative supervision, essence of administrative tutelage, the control of legality and the control of expediency of acts of local authorities in relations within the central government – local authorities. The work allowed to realize the common features of the supervision of the central executive authority over local authorities’ activity in Moldova in comparison with the administrative supervision in the other European countries.
The conclusions and results of the research are the basis of: (а) scientific and practical recommendations concerning the development of modern forms and methods of administrative supervision over local authorities and (b) elaborated draft regulations.
The implementation of these recommendations will allow to combine harmonically local and national interests, help local communities to settle and administrate a significant part of public affairs, it will also enable the central executive authority to provide proper functioning of the hole administrative system in the interests of the society.
The results of thesis can be used as a teaching material and for the purpose of drafting amendments to
the legislation.
