The theisis is dedicated to the judicial, thoroughly scientific analysis of crimes connected to the fight against drug traffic and illegal drugs consumption in Romania and in the Republic of Moldova and also to some solutions to current problems of judicial theory and practice.
The analysis has also focused on the judicial treatment applied to drugs and psychotropic substances according to the international conventions and the subsequent amendments which regulate the field under study.
The investigation and analysis of the legislative premises were based on the study of the existent laws. The methods used are historical, judicial, logic, doctrinaire and jurisprudencial, combined with the international tradition. The following categories have been used as direct sources: provisions of the Romanian Criminal Code, The Criminal Code of the Republic of Moldova, The Romanian Criminal Procedure Code, laws adopted in Romania and in the Republic of Moldova, ruling of the Supreme Court of Justice of the Republic of Moldova, decrees of the romanian Government, ministerial decrees and International Conventions specific to the field under study.
The thorough and well-founded research of the multiple types and forms of legal and illegal drugs, of the legal and illegal drugs consumption and of the consequences of drugs consumption shows the necessity of preventingand fighting against drug traffic and illegal drugs consumption.
Therefore, the eradication of the crimes connected to the circulation of psychotropic substances and narcotics must concern both the state organs and the whole society.
The analysis of legislation and judicial practice in the criminal field of Romania and the
Republic of Moldova, the practical experience gathered in the last three decades by the Romanian
Police Forces, the quality of founder member of the Romanian Antidrug Foundation, the National
Association Young Jurists and of the Romanian Association of Criminalogists have allowed the
author to formulate proposals for law which deal particularly with the crimes subjects, the
facilitation of investigations, the treatment for drug addicts, the protection of judicial organs etc., in
order to create mechanisms for an efficient and balanced cooperation among all the organs that fight
against this scourge.
