Summary

The purpose of this doctoral thesis is to make a complex criminological analysis of the crime of illegal provocation of abortion, through the elucidation of the causes and the conditions related to it, in order to elaborate effective special criminological and victimological measures to prevent this criminal phenomenon.

Objectives - to elucidate and analyze the statistical indicators for the spread of illegal abortions on the territory of the Republic of Moldova, to determine the characteristics of the personality of the offender involved in committing the illegal abortions, to elucidate the personality traits of the victim of the illegal abortions and its role in triggering the criminal act mechanism, and individual miscarriage of illegal abortions, the design of measures for the victimological prevention of illegal abortions, the submission of some recommendations as a law for the improvement of the existing normative framework in the field of prevention of illegal abortions.

Novelty and scientific originality of the obtained results. This PhD thesis is one of the earliest scientific researches on the criminological investigation of illegal abortions, whose scientific novelty has been reflected in a number of scientific results aimed at criminological and victimological effective prevention of the offense of unlawful provocation of abortion.

The important scientific problem solved consists in the scientific substantiation of the general, special-criminological, individual and victimological measures of effective prevention of illegal abortions by the competent bodies through the identification of the causes and conditions underlying the genesis and conditioning this criminal phenomenon, as well and traits that make the personality of the offender and the victim of the offense particular.

Theoretical significance and applicative value of the work. The paper is an integral research into content, in which the theoretical approaches to the content of the criminological characteristics and the measures of effective prevention of the phenomenon of illegal abortions were systematized. These results can be reflected in the activity of scientific research, including an adjacent phenomenon, such as the infanticide, the instructive-formative, in the practical activity of the law enforcement bodies and in the lawmaking process.

Implementation of scientific results. The scientific results are used in the process of setting up students, masters and doctoral students in higher education institutions with a legal background, as well as in the practical work of the law enforcement bodies.
