Summary

Conviction with conditional suspension of punishment against children. Legal and social – psychological. PhD thesis in law, Chisinau. 2010. Thesis structure is the following: introduction, three chapters, conclusions and bibliography with 287 assignments, and 183 pages of main text. The acquired results are published in 8 scientific works. Key words: suspension of enforcement, sentencing, juvenile, legal, socio – psychological problems. Field research of the thesis concerns the institutions of criminal law, in particular conviction with conditional suspension of punishment against children and its role in regulating the legal relations of criminal conflict. The purpose of the work consists of carrying out extensive investigations on the institution of conviction with conditional suspension of punishment against children determined by national legislation Republic of Moldova and Romania and developing appropriate recommandations to improve the legislative provisions in the area. Thesis objective is placed in the definition, the essence of the legal framework and legal nature of conviction with conditional suspensions of punishment, as well as a distinction from other similar institutions. Scientific novelty and originality of the study consists of: clarifying complex issues in various aspects of the institution conviction with conditional suspension of sentence, suspended sentence fleshing out the concept of enforcement, establish the legal nature of this institution, the analysis of the statutory provisions of several European countries. The survey consists of scientific originality and to formulate concrete proposals to improve. Theoretical significance and applied value is that theoretical theses and dissertation findings and applied such suggestions and recommandations can be used; in the legislative process to improve legislation in Romania and Moldova with the development of scientific investigations seeking suspension of enforcement; the criminal law teaching materials in schools in law; in courts work. Implementation of scientific results. Scientific results are implemented in the training of students in Free International University of Moldova.
