Summary

The thesis is dedicated to the study of scientific- practical problems. Regarding the realization of the constitutional rights of the person and the citizen to the entrepreneurial activity in the Republic of Moldova.

In this context, is considered the fact that the notion, concept and principles, lain on the basis of the notion „constitutional rights of the person and citizen to the entrepreneurial activity”, are considered.

The thesis begins with the revealing of the notion “entrepreneurial activity” during centuries, its evolution depending of the social-political and economical conditions in the society. The juridical basis and the essence of the constitutional rights of the person and citizen to the entrepreneurial activity in the Republic of Moldova are studied, in the conditions of market economy.

A separate place is dedicated to the study of the legal concretization of the given right in the Constitution of the Republic of Moldova, branch legalization, constitution of developed countries, constitution of the countries with new democracy such as countries of the Central and Eastern Europe. A number of problems in the realization of the constitutional rights of the person and citizen to the entrepreneurial activity in the Republic of Moldova in normative documents, constitutions of other countries as well as in international documents.

A special place is dedicated to the research of constitutional guarantees (political, economical, and legal) as an objective necessity to ensure constitutional rights of the person and citizen to the entrepreneurial activity in the Republic of Moldova.

In the end, is made an attempt to formulate a number of conclusions and recommendations, aiming at improving the situation in this field. It can be used as didactical material for studies in the juridical faculties of the Universities.
