Summary

The scientific thesis is established to problems of capitalization in intern – penal legislation of Republic of Moldova and Romania of stipulation of international documents in the domain of fighting of the delinquency that keeps of the circulation and the illegal consumption of drugs, their harmonization with the provision intern - penal of other European states in the purpose of the elaboration of a coherent system of fighting this negative phenomenon so for the national level, as for international level.

In this work are elucidated the main problems with who the European states are confronting in the process of building of an efficacious systems from the paint of view of stopping the crimes about narcotics. The author had analyzed so the penal legislation in this subject of France, Holland, Spain, Portugal, Italy etc., as the opinions of the specialists established in domain from respective countries.

A great attention was accorded to the analysis of penal legislation of republic of Moldova in the sphere of incrimination of the crimes connecting the drugs through viewpoint of their corresponding to the norms of international documents and their practice of efficient fighting in the European Unions.

In the same time, was accorded the necessary attention to scientific elaboration in realized domain also in republic of Moldova; judicial practice of this countries looking at crimes connected of circulation and illegal consumption of drugs.

Al the base of the effectuated analysis, the author is advancing a file of purposeless and recommendations designated to remove the judicial gaps and to harmonize the penal - inter legislations of Republic of Moldova and of Romania with the international legislation and the legislations of member - countries of European Union in domain of incrimination of the crimes connected with drugs.

The results of this investigation can be used at the elaboration of projects of changing the penal legislation, as they can contribute at the efficient studying of the problems of criminal law at the Faculties of Law of Romania and of Republic of Moldova.
